The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the crisis sparked by the announcement of a new comprehensive peace framework for achieving ceasefire appeared – briefly – to have been contained. A American diplomat spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its retaliation: an extensive attack of rocket attacks on Kyiv.

The Cycle of Peace Talks and Military Action

The chain of conflicting incidents captured the bleak nature of the current period. By day, diplomatic battles are conducted: positive announcements are issued from multiple capitals. Significant resources is expended on containing certain initiatives. By night, the Kremlin clearly shows the world that, for them, war remains the main instrument for achieving "settlement".

After-Dark Attacks

As Russia's attack developed into the early hours of Tuesday, the present situation of Ukraine's exposure was exposed. Ukraine is able to track rocket firings from Russian territory, a capacity provided through timely intelligence. From observation points, defense planes that had been deployed to engage hostile guided weapons roared overhead – sophisticated military planes provided to Ukraine by European allies.

Shortly after, Kyiv's air-defence systems activated: multiple launches fired to intercept a Russian ballistic missile. This was a advanced protection mechanism at work, most likely provided by Western nations. Every firing jolts you unexpectedly, shaking the windows. The moment of terror quickly gives way to sober acceptance: maybe the hostile projectile won't strike its target this time, sparing the city from ruin and additional electricity failures.

Continuous Dangers

Not long after, a large-caliber weapon opened up on a aerial vehicle close by, part of a rapid response unit – almost certainly allied-provided weaponry. Sadly, the projectiles didn't strike the opposing UAV – it pressed on overhead toward its destination.

Intermittently, this persisted until dawn. Kyiv awoke to the daybreak reports: seven people killed, damage and heating outages in numerous residences as a result of the nocturnal offensive. As always, everyone still continued their routines – experiencing conflict. But those full day demonstrated Ukraine's vital need on external assistance – a need that European nations are clearly incapable to replace in the near term.

Ineffective Peace Efforts

The detailed framework from Washington provoked deep reactions, debate and deep concern – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after prior negotiation attempts and international summits.

Every new approach from Washington unfolds according to the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, manages to fend off. They manage the tension but never actually win the battle. This trend will, undoubtedly, persist.

Tactical Assessments

It is easy to blame specific actors of persistently promoting Russian terms. But that does not seem to be the complete picture. US administration works based on a principle familiar among seasoned negotiators: you cannot win at the negotiating table what you have lost on the battlefield. The US administration assumes that it is unrealistic to pressure the Kremlin to relinquish the land that it currently occupies in Ukraine's southern or eastern regions.

The issue is that while recognising this factual reality, American administration does nothing to prevent Kremlin actions, through diplomacy or military means, from assuming that the situation will not shift further in its advantage in the near future.

Conflicting Perspectives

Therefore, Moscow is convinced that time is on his side – that Ukraine and its partners are approaching exhaustion. Their reason to accept conditions that does not give them the maximum possible gain is virtually nonexistent. There may be multiple initiatives to end hostilities, but they will continue as long as Russia's government remains supremely confident in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, progressively conceding lives and land but preventing a total frontline collapse until circumstances change in its favour.

Existing Situation

Objectively, there are no actual prerequisites for a ceasefire. Now, personal considerations are entering the equation: political desires to mediate resolution and obtain worldwide acknowledgment, and Kyiv's twin challenges – on one hand, not to distance important partners, and on the other, to rally Ukrainians around the national cause against any plan Kyiv finds unacceptable, so that their priority does not move to internal issues. And although their task will now be considerably more difficult after latest incidents, it remains quite doubtful that this will change their overall approach.

These conflicting dynamics are influencing discussions.

Assessment and Future

It took a only one week to kill the suggested clauses of the latest plan. Forceful and unpredictable management of the matter by US administration, pushback by Ukraine and the rest of Europe, along with soothing efforts of negotiators, and finally, current information leaks, all served their function.

While new plans based on previous concepts are approaching, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are rooted in Kremlin requirements and demonstrate specific hesitation to modify developments, if they maintain solidarity and enhance their military capacity at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to overcome them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the foreseeable future, mainly require sustained allied backing.
